Lunarcore, Inc. ("Lunarcore," "we," "our," or "us") is committed to protecting the privacy of our customers, users, and website visitors. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our platform at lunarcore44.com and any related services (collectively, the "Services"). If you are located in the European Economic Area, you have the right to access, rectify, erase, restrict processing, and port your personal data. Terms of Service
1. Acceptance of Terms
By accessing or using the Lunarcore platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, you may not use the Services.
2. Services and License
Subject to these Terms and payment of applicable fees, Lunarcore grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes. You may not sublicense, resell, or make the Services available to third parties without our prior written consent.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use. You agree not to use the Services for any unlawful purpose, to transmit harmful code, to violate intellectual property rights, to engage in unauthorized data collection, or to interfere with the Services' operation.
4. Payment and Billing
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specified in our refund policy. We reserve the right to modify pricing with 30 days' written notice. Failure to pay may result in suspension or termination of your account.
5. Intellectual Property
Lunarcore retains all intellectual property rights in the Services, including software, designs, trademarks, and documentation. You retain ownership of all data and content you submit to the Services. You grant Lunarcore a limited license to process your data solely to provide the Services.
6. Service Level Agreement
We target 99.97% monthly uptime for the core platform. In the event of downtime exceeding our SLA thresholds, eligible customers may receive service credits as described in our SLA documentation. Scheduled maintenance windows are excluded from uptime calculations.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Lunarcore's total liability for any claims arising under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages.
8. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in any court of competent jurisdiction.
9. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
